The introduction of the 'Control of Asbestos at Work 2002' regulations has placed an explicit duty on many people........

Those responsible for the maintenance of a building have a specific duty to identify, manage and understand the issues involved with asbestos containing materials, this has been fully explained in the CAW Regs 2002 (see summary below).

The decision to manage asbestos within a building or remove is affected by many factors, however, risk and the financial consequence are usually high on the priority list.

Summary of the main changes to the CAW Regulations 2002

The main change was to widen the definition of the duty holder. The employer in occupation of the premises will still have the main duty to ensure the requirements of the duty to manage regulation are met. The proposal now is to also introduce a duty on all those who legally have maintenance and repair responsibilities for any part of the premises to take the actions necessary to enable the employer to comply with these requirements.

In the new regulation those responsible for workplace premises will be required to:


• Find out whether asbestos is present in their buildings, where it is located and what condition it is in
• Assume that materials contain asbestos unless they can be sure they do not
• Record their findings
• Assess the risks from these materials
• Prepare and implement plans to manage the risks from such asbestos
• Provide information to anyone liable to come into contact with asbestos

Control of Asbestos at Work Regulations 2002 were made on the 24th October 2002

They came into force – All regulations except regulation 4 and 20, on the 21st November 2002
